Child custody is determined by the "Best Interest of the Child". Best Interest of the Child is a legal term that requires the judge, should the need arise, to evaluate twelve factors codified in Louisiana Civil Code Article 134. The judge has the discretion to determine the weight of each factor in determining child custody. Most courts will try to give equal time to each parent.
